The parties had not signed any settlement agreement, and the attached documents were unsigned templates intended for further negotiation. The mediator's filing of the template as a settlement agreement misrepresented the parties' position and misled the court into adopting it as an order. Since no binding mediation settlement agreement existed, the orders of 12th March 2018 adopting the purported settlement were set aside. The executor's application to enforce the non-existent settlement was dismissed for lack of merit.
