Procedural Posture

Succession Cause / Judgment

  1. 1 Whether the BuruBuru house should be wholly allocated to Marylyne Ochola Rapudo or sold and proceeds shared among all beneficiaries.
  2. 2 Whether Marylyne Ochola Rapudo is entitled to a share of the proceeds from the sale of LR No. Busia/Municipality/315.
  3. 3 How the ancestral land should be distributed among the beneficiaries.

Ratio Decidendi

The court found that the BuruBuru house, originally registered as a joint tenancy between the deceased and his first wife Judith, vested fully in the deceased upon Judith's death by operation of the right of survivorship. Upon the deceased's death, the property formed part of his estate to be distributed among all his beneficiaries. The court rejected Marylyne's claim for exclusive allocation, holding that all beneficiaries are entitled to equal shares. The court also found that Marylyne is entitled to 1/7 of the net rental income from the BuruBuru house until its sale, and to 1/7 of the proceeds from the sale of LR No. Busia/Municipality/315, as she did not benefit from the earlier sale....

Court Disposition
