Ratio Decidendi

The court held that rectification of the Certificate of Confirmation of Grant is permissible under Section 74 of the Law of Succession Act and Rule 43 of the Probate and Administration Rules for minor errors such as misdescription of property or names. The court found that the corrections sought in prayers (a) and (c) were within the scope of rectification as they merely corrected property descriptions. Although prayer (b) sought substitution of a deceased beneficiary with his administrator, which is not strictly within the scope of Section 74, the court exercised its inherent power under Rule 73 to allow the substitution in the interests of justice, as all beneficiaries had consented....
