Ratio Decidendi

The court found that the Citor failed to notify the Citee of the existence of ELC.396/2018 or his intention to cite her for letters of administration. The Citee was not given an opportunity to take out letters of administration voluntarily and was only made aware of the relevant pleadings after the citation had been filed and further affidavits submitted. The court held that due process requires the Citor to notify the person to be cited before initiating citation proceedings. As the Citor rushed to court without such notice, the Citee was unnecessarily dragged into litigation.
