Procedural Posture

Succession Cause / Ruling on Petition for Grant of Probate and Objection

  1. 1 Whether the Will dated 4th May 1976 propounded by the petitioner is genuine and valid.
  2. 2 Who should be issued with the grant of probate for the deceased's estate.
  3. 3 Whether the petition is incompetent for failure to annex the original Will.

Ratio Decidendi

The court found that the Will dated 4th May 1976 was validly executed by the deceased and properly attested, based on the credible evidence of one attesting witness and the comprehensive forensic analysis by Mr. Radley, who had access to known writings of the deceased. The objector's expert, Mr. Nyanjwa, lacked access to such writings and his report was found unsatisfactory and lacking material support. The petitioner's failure to annex the original Will was justified by the risk of loss, and the authenticated copy sufficed under the law. The petitioner's non-appearance as a witness was not fatal, as she was not an attesting witness and the issue was the Will's validity, not her conduct....

Court Disposition

Objection and cross-petition dismissed; grant of probate of the Will dated 4th May 1976 issued to the petitioner; costs awarded to the petitioner.
