The court held that the death of one out of several joint administrators does not render a grant of letters of administration useless or inoperative. Section 81 of the Law of Succession Act vests all powers and duties of administration in the surviving administrators. Therefore, the surviving administrators may continue to administer the estate without the need for immediate revocation or issuance of a fresh grant. However, given the polygamous nature of the deceased's family and the need for equitable representation of both houses, the court found it desirable for the 2nd house to nominate a replacement administrator for the deceased administrator, Mary Wangechi Kamara.
