Ratio Decidendi

The Law of Succession Act does not provide for substitution of deceased administrators with new ones. Section 81 only allows surviving administrators to continue if one or more die, but does not address the situation where all administrators have died. In such a case, the grant becomes useless and inoperative and must be revoked under section 76(e) of the Act. Thereafter, a fresh application for a new grant must be made in accordance with the procedures set out in the Act and the Probate and Administration Rules. The application for substitution, therefore, is not tenable in law and must be dismissed.
