The court found that the issues raised in the objection proceedings were the same as those determined in Eldoret CMCC 128 of 2011, involving the same parties and subject matter. The objector had participated in the earlier proceedings and did not appeal the decree. The doctrine of res judicata, as set out in Section 7 of the Civil Procedure Act, bars the court from entertaining the objection, as all essential elements of the doctrine were satisfied.
