The court found that the grant was obtained fraudulently by the making of a false statement and by the use of a forged consent, as it purported to bear the signature of Wilson Kipkemboi Koros after his death. The 2nd petitioner was improperly listed as a beneficiary when he was merely a purchaser, and the consent of all beneficiaries was not validly obtained. The court held that the 1st petitioner, as the widow under a recognized woman-to-woman marriage, ranked in priority for administration, but the applicant, as a beneficiary through the deceased's brother, also had a right to administer the estate. The sales of land prior to confirmation of grant were contrary to the Law of Succession...
