Ratio Decidendi

The court held that the Law of Succession Act does not provide for the substitution of a deceased administrator with another person where there are surviving administrators. Section 81 of the Act vests all powers and duties in the surviving administrators, who are authorized to continue with the administration of the estate to completion. The application for substitution was therefore untenable, as the proper procedure in the event of the death of an administrator is for the surviving administrators to proceed, not for a new administrator to be substituted. The application was dismissed accordingly.
