Ratio Decidendi

The High Court, sitting as a succession court, lacks jurisdiction to determine disputes concerning title to land and allegations of fraudulent transfer of land forming part of a deceased's estate. Such disputes fall within the exclusive jurisdiction of the Environment and Land Court as provided by Article 162(2) of the Constitution. The application before the court, seeking cancellation of title deeds allegedly obtained fraudulently and without succession proceedings, is therefore not properly before the High Court. The preliminary objection is merited, and the application is struck out for want of jurisdiction. Each party is to bear its own costs given the nature and gravity of the dispute.
