The purported sales by Silas and Rose were not valid as they lacked the deceased's consent and were not sanctioned by the court. Section 35 of the Law of Succession Act, interpreted in light of the Constitution, requires equal distribution among the surviving spouse and children unless there are compelling circumstances to depart from equality.
