The production of a birth certificate naming the deceased as father, which was not challenged for authenticity, sufficed for this purpose. The court held that a child need not have been maintained by the deceased prior to death to qualify as a dependant. The court further held that, in the best interests of the child and guided by the value of the estate and its liabilities, it was reasonable to order a monthly payment of KES 100,000 to the applicant for the maintenance of the minor,...
