Ratio Decidendi

The applicants, being beneficiaries of the estate and having the consent of other beneficiaries of equal priority, are eligible and suitable for appointment as administrators. Section 66 of the Law of Succession Act vests the court with discretion to appoint administrators, giving preference to beneficiaries. The court was satisfied that the application had merit and that appointing the applicants would ensure proper management of the estate.
