Ratio Decidendi

The court found that the only documentary evidence linking CM to Godfrey Kirimi Kithinji was a birth certificate issued after Godfrey's death, while all other evidence, including baptism and school records, identified Sospeter Muriithi as CM's father. The court held that the respondent failed to prove on a balance of probabilities that CM was the son of Godfrey Kirimi Kithinji. Consequently, the inheritance due to Godfrey Kirimi Kithinji from his deceased father should be transmitted solely to Elosy Wanja Njeru and her son Cliff Muguna Kirimi in equal shares. The Certificate of Confirmation of Grant was ordered to be rectified accordingly.
