The High Court determined that it lacked jurisdiction to entertain the application for revocation or annulment of a grant issued by a magistrate's court. The court relied on statutory provisions and case law establishing that only the court which issued the grant has jurisdiction to revoke or annul it, and that the High Court can only intervene on appeal. Subsidiary legislation such as Rule 44 of the Probate and Administration Rules cannot override the express provisions of the Magistrates’ Court Act. Consequently, the application was dismissed for want of jurisdiction.
