The court held that the applicable law for the succession of the deceased, a Muslim, is Islamic law, not the Laws of Succession Act. Under Islamic law, a will can only be made in favour of non-heirs and is limited to one-third of the estate. The deceased's 2010 will, which bequeathed the entire estate to two daughters (heirs), contravened these requirements and was therefore invalid. The earlier 2003 will was revoked by the 2010 will. As a result, the estate must be distributed according to the fixed shares prescribed by the Qur'an for Muslim heirs.
