The court held that it lacked jurisdiction to determine disputes over ownership of land between the estate and third parties, such as the objector and alleged purchasers, as these are matters for the Environment and Land Court. Accordingly, the properties subject to such disputes (Mitaboni/Mutituni/391 and Mavoko Town Block 3/1991) were excluded from distribution and would remain vested in the administrators pending resolution in the appropriate forum. As for the distribution of the remainder of the estate, the court found that, in the absence of a surviving spouse, section 38 of the Law of Succession Act required equal distribution among all surviving children.
