Procedural Posture

Succession Cause / Ruling on Summons for Revocation of Certificate of Confirmation of Grant

  1. 1 Whether the certificate of confirmation of grant was issued in accordance with the written will of the deceased.
  2. 2 Whether the Administratix was entitled to take certain properties absolutely or in trust for all beneficiaries.
  3. 3 Whether the delay of 12 years in bringing the application for revocation was justified.

Ratio Decidendi

The court found that the certificate of confirmation of grant was not entirely in accordance with the written will of the deceased. The deceased intended for certain properties to be held jointly by himself and the Administratix, and not to be devolved absolutely to the Administratix. The court held that half of the undivided shares of the deceased's remaining properties should go to the Administratix, who would hold them in trust for all beneficiaries, except for specified items such as two motor vehicles and certain shares. The court exercised its inherent powers to rectify the certificate of confirmation of grant to reflect the true intentions of the deceased as expressed in the will....
