Ratio Decidendi

The Court found that the 3rd Applicant, Raphael Kinyua Kirimi, is a biological son of the deceased and thus a dependant within the meaning of Section 29 of the Law of Succession Act. The grant was confirmed without disclosure of his existence, constituting a material non-disclosure warranting revocation under Section 76. The claims by the 1st and 2nd Applicants, based on trust, fall outside the jurisdiction of the probate court and must be determined by the Environment and Land Court. The Court therefore revoked the grant and ordered that the estate, specifically L.R No. Abothuguchi/913, be shared equally between Faith Karimi Misheck and Raphael Kinyua Kirimi. No order as to costs was made.
