The reasons advanced, namely old age and the illness of counsel, were unsupported by evidence, and no affidavit was sworn by the allegedly ill counsel. The court held that the delay was inordinate and unjustified, and therefore declined to exercise its discretion to enlarge time. Since enlargement of time was denied, the prayer for stay of execution was rendered moot, as there was no valid appeal in place.
