The High Court found that the trial court erred in two respects: first, by distributing the deceased's estate unequally among the sons and the grandson, despite clear evidence that the sons had already inherited substantial land from their late father, while the appellant, as the child of a predeceased daughter, was entitled to step into his mother's shoes and claim her share under the Law of Succession Act. Second, the trial court erred by including the Thika property in the estate without sufficient proof that it belonged to the deceased.
