Procedural Posture

Succession Cause / Ruling on Applications for Revocation and Appointment of Administrators

  1. 1 Whether the grant of letters of administration should be revoked due to the death of all administrators.
  2. 2 Whether the applicants should be appointed as new administrators of the estates of Esther Wanjiku Maina and Maina Kabutha.

Ratio Decidendi

The court found that all administrators to the estates in question had died, rendering the grants useless and inoperative under Section 76(e) of the Law of Succession Act. The law and precedent establish that grants are personal and not transferable; upon the death of the holder, the grant must be revoked and a fresh application made. The court therefore revoked the existing grants and allowed the applicants liberty to petition for fresh grants of letters of administration, in accordance with the prescribed legal procedures.

Court Disposition

Applications for revocation of grant allowed; applicants at liberty to petition for appointment as administrators.
