The court found that the grant of letters of administration and the certificate of confirmation issued by the Chief Magistrate's Court were null and void for want of jurisdiction. The Resident Magistrate who issued the grant had a pecuniary jurisdiction limited to estates not exceeding Ksh. 5 million, while the value of the estate, as per the respondents' own affidavit, was Ksh. 20 million. The court held that jurisdiction cannot be conferred by parties or by error, and any proceedings conducted without jurisdiction are a nullity.
