Procedural Posture

Succession Cause / Judgment

  1. 1 Whether the administrator failed to complete administration of the estate within the statutory period.
  2. 2 Whether the grant issued in 1985 should be revoked due to exclusion of some beneficiaries and incomplete distribution of assets.
  3. 3 Whether a fresh grant should be issued to new administrators representing all beneficiaries.

Ratio Decidendi

The court found that the administrator failed to complete the administration of the estate for over 36 years after confirmation of the grant, contrary to statutory requirements. The process in 1985 was not inclusive, as only two out of six family members were involved and only one of two assets was distributed. The exclusion of other beneficiaries and the failure to transmit the estate amounted to a fundamental failure in administration. To ensure justice and inclusivity, the court revoked the previous grant, appointed new administrators from both sides of the family, and ordered a fresh process for confirmation and distribution involving all survivors.

Court Disposition

Grant revoked; new administrators appointed; fresh grant to issue; prior confirmation orders vacated; parties to bear own costs; liberty to appeal.

Orders

  • The grant made to Christopher Enos Likuyi on 15th October 1985 is revoked.
