Miscellaneous Application / Ruling on Application for Letters of Administration Ad Litem

  1. 1 Whether the applicants are entitled to letters of administration ad litem to challenge the transfer of the deceased's estate.
  2. 2 Whether the transfer of LR. IGOJI/KINORO/81 to the respondents was fraudulent and unlawfully disinherited the applicants.
  3. 3 Whether the estate was distributed in accordance with Ameru Customary Law or the Law of Succession.

Ratio Decidendi

The court found that the applicants had demonstrated a prima facie case and a legitimate expectation to benefit from their father's estate. The court held that it would be improper to determine the merits of the intended suit at this interlocutory stage, as doing so would violate the rules of natural justice and the applicants' right to be heard. The court was persuaded that the applicants are entitled to have their day in court and, therefore, granted them letters of administration ad litem to enable them to institute proceedings against the respondents regarding the alleged unlawful transfer of the deceased's estate.
