The court found, based on the testimony of the Land Settlement Officer and documentary evidence, that Buluma Shanina alias Baluma Shanina was the lawful allottee of land parcel No. Bungoma/Tongaren/238. The Objector failed to discharge the burden of proof required to establish that his mother was the allottee or that he and his siblings were dependants of the deceased. The Petitioner, on the other hand, provided credible and uncontroverted evidence of his relationship to the deceased and entitlement to the estate. The Objector's actions, including instituting parallel succession proceedings and attempting to insert his mother as the allottee, amounted to intermeddling with the estate. The...
