The court found that the Objector's evidence of exclusion from the succession proceedings and burial arrangements was uncontroverted, as the Respondents failed to respond or appear despite proper service. The 1st Respondent did not prove marriage to the deceased, and the omission of the Objector as a beneficiary constituted concealment of material facts. The grant and confirmed grant were therefore obtained fraudulently and in contravention of the Law of Succession Act. The court revoked the grant and ordered that a fresh grant be issued to the siblings of the deceased, excluding the 1st Respondent unless he proves marriage to the deceased.
