The applicant, RW, is the only close relative, has been recommended by the area chief and employer, and has been solely responsible for FMM's care. The statutory requirements under the Mental Health Act for appointment of a guardian and manager have been satisfied. The court exercised its discretion under section 26 of the Act to appoint RW as the legal guardian and manager of FMM and his estate, in the best interests of the patient.
