Procedural Posture

Succession Cause / Judgment

  1. 1 Whether the administrators failed to diligently administer and distribute the estate of the deceased in accordance with the law.
  2. 2 Whether the administrators fraudulently obtained confirmation of grant by making false statements or concealing material facts.
  3. 3 Whether the administrators failed to render accounts of the estate as required by law.

Ratio Decidendi

The court found that the confirmed grant of letters of administration was based on an untrue allegation that all beneficiaries had consented to the proposed distribution, as there was no valid power of attorney authorizing the applicant's sister to consent on her behalf. Although fraud was not proved to the required standard, the administrators failed to comply with the legal requirement to ascertain all assets and obtain genuine consents before confirmation. The omission of certain properties was not fraudulent but should have been addressed through rectification. The applicant's placement of caveats contributed to delays but did not excuse the administrators from their statutory duties....

Court Disposition

Confirmed grant of letters of administration revoked; fresh grant to issue to existing administrators plus two additional co-administrators; outgoing administrators to render accounts; certain properties excluded from distributable estate; no order as to costs.
