Miscellaneous Application / Ruling on Application for Presumption of Death
Legal Issues
- 1 Whether Fred Ondieki Makori should be presumed dead under Section 118A of the Evidence Act.
- 2 Whether sufficient evidence has been provided to support the presumption of death.
Ratio Decidendi
The court found that Fred Ondieki Makori had not been seen or heard from for over seven years despite diligent efforts by his family and relevant authorities, including police reports, hospital records, and public notices. Applying Section 118A of the Evidence Act, the court held that the legal threshold for presumption of death had been met. The absence of any evidence to the contrary and the comprehensive steps taken to locate Fred Ondieki Makori justified granting the order sought. The court therefore presumed Fred Ondieki Makori dead and allowed the application as prayed.
Court Disposition
