Ratio Decidendi

The court found that the four applicants did not sign the consent to the mode of distribution and there was no evidence that they were present in court to confirm their agreement to the proposed distribution. The applicants were not adequately involved in the confirmation process, and their right to participate and consent was not respected. The court held that it would be appropriate to set aside the order confirming the grant to allow all parties to participate in formulating an amicable mode of distribution. The objection to Githuka Advocate representing his mother was dismissed as no clear conflict of interest or prejudice was demonstrated.
