As such, it does not form part of the estate for distribution in this succession cause, and any trust or ownership disputes must be addressed in a separate suit before the Environment and Land Court. Applying section 42 of the Law of Succession Act, the court held that the petitioner's prior benefit from the gift inter vivos must be taken into account, and it would be inequitable to allow him a further share in the remaining estate.
