The High Court found that although there were procedural missteps and possible exclusion of beneficiaries during the confirmation of grant, the trial magistrate erred in revoking the grant under Section 76 of the Law of Succession Act. The court held that dissatisfaction with the confirmation of grant should be addressed through appeal or review, not revocation, as the court becomes functus officio after confirmation. The trial magistrate overstepped by revoking the grant on grounds that did not meet the statutory threshold.
