The court found that the respondent, as the deceased's sister, did not have legal priority to apply for letters of administration over the applicant, the surviving spouse. The respondent failed to disclose the existence of the deceased's spouse and children in her application, contrary to Section 51(2)(g) of the Law of Succession Act and Rule 26 of the Probate and Administration Rules, and did not obtain their consent. This constituted material non-disclosure and defective proceedings. The law gives first priority to the spouse and children in administration of an intestate estate, and the respondent's actions in excluding them and distributing the estate to herself and other family...
