Ratio Decidendi

The court held that substitution of a deceased sole administrator is not permissible under the Law of Succession Act or judicial precedent. A grant of representation is personal to the administrator and becomes inoperative upon their death. Since the original grant had already been revoked in 2018, there was no grant capable of confirmation or substitution. The only lawful procedure is for the beneficiaries or interested parties to petition afresh for a new grant of letters of administration. The application for substitution was therefore dismissed, and the applicants were directed to follow the proper statutory process for appointment as administrators.
