The court found that the application for stay of execution was unopposed and, upon considering the applicant's averments and the supporting affidavit, determined that it was appropriate to preserve the subject matter of the appeal. The court exercised its discretion to grant a stay of execution of the orders dated 27th April, 2013, pending the hearing and determination of Nyeri Civil Appeal No. E107 of 2023, in order to ensure that the appeal would not be rendered nugatory and to balance the interests of both parties. Costs were ordered to be in the cause.
