Ratio Decidendi

Since the deceased died before the Law of Succession Act came into force, the estate was to be distributed according to customary law and the deceased's intentions, as evidenced by his actions during his lifetime. The deceased had already given parcel No. 23 to the first house, and it was his intention that parcel No. 182 go to the second house. The court held that the confirmed grant did not reflect this intention and set it aside, ordering a fresh grant in accordance with the deceased's customary will.
