Ratio Decidendi

The court found that Title No. Tetu/Kiriti/15 was transferred to the protestor during the deceased's lifetime and thus does not form part of the estate for distribution. In accordance with section 42 of the Law of Succession Act, the protestor's share in the remaining estate must be reduced by the value of the property already received. The court also held that all surviving children, including Mary Wahu Warutere, are entitled to a share of the estate, as there was no valid renunciation of her inheritance rights. The estate, except for the excluded parcel, is to be distributed equally among the five beneficiaries, with the protestor's share adjusted to account for the inter vivos transfer.
