The court found that the grant of probate issued to Akberalli Goolam Hoosain Keshavjee became inoperative and useless upon his death before completing administration of the estate. Section 76(e) of the Law of Succession Act empowers the court to revoke such a grant. The applicant, Amynmohamed Akberalli Keshavjee, is the sole executor and beneficiary of the deceased executor's estate, having obtained a grant in Canada and its resealing in Kenya. There are no other known beneficiaries or persons entitled to the estate.
