Procedural Posture

Succession Cause / Ruling on Applications to Review and Clarify Confirmation of Grant

  1. 1 Whether the court should review or vary the confirmed grant to include additional bank accounts as part of the estate for distribution.
  2. 2 Whether the consent filed by some administrators without the participation of all, particularly the 2nd applicant, can validly vary the court's confirmed grant.
  3. 3 Whether the distribution of certain properties and bank proceeds should be altered from the original confirmation ruling.

Ratio Decidendi

The court held that the confirmed grant and the distribution order made on 26th October 2016 are binding on all beneficiaries and administrators unless properly reviewed or set aside by the court. The consent entered into by some administrators, excluding the 2nd applicant, could not validly vary the court's order and was set aside. The court found that the proceeds of Barclays Bank Account No. 0673542123 and Equity Bank Account No. 0820192970653 had not been distributed in the original ruling and ordered that these be shared equally among all beneficiaries. The Standard Chartered Bank accounts were clarified and their proceeds also ordered to be shared equally among all beneficiaries....

Court Disposition

Partial review and clarification of confirmed grant; main application by 2nd applicant dismissed; estate to be distributed as per original confirmation with specified inclusions.

Orders

  • Application dated 24th July 2018 by the 2nd applicant is dismissed.
