Ratio Decidendi

The court found that the Will dated November 29, 2016 was not validly executed as required by section 11 of the Law of Succession Act. The evidence showed that at least one of the attesting witnesses, Stephen Warui Nguyai, did not sign the Will in the presence of the testator, but rather at his own home after being brought the Will by the testator's son. This failure to comply with the statutory requirement for attestation rendered the Will invalid.
