Legal Issues
- 1 Whether the issues raised in the application for revocation of grant are identical to those in HCC No. 137 of 2011.
- 2 Whether it is efficient and prudent to have both matters determined simultaneously by one judge.
Ratio Decidendi
The court determined that the main issues in the application for revocation of grant are also raised in the pleadings of HCC No. 137 of 2011, which is pending before the Environment and Land Court. To avoid duplication and ensure efficient administration of justice, the court ordered that both matters be placed before the same judge for directions on further proceedings. This approach promotes judicial economy and consistency in the determination of related disputes involving the same estate and parties.
Court Disposition
Matters consolidated for directions before one judge.
Orders
- This cause and HCCC No. 137 of 2011 to be placed before Angote J on 10th December, 2013 for directions as to further proceedings.

REPUBLIC OF KENYA
IN THE HIGH COURT AT MALINDI
SUCCESSION CAUSE NO. 11 OF 2010
IN THE MATTER OF THE ESTATE OF HEMED KALE HEMED (DECEASED)
DIRECTIONS
Upon a careful consideration of the issues related to the application for revocation of the grant issued to Maryam Hemed Kale, in respect of the estate of the deceased herein, and the pleadings in HCC No. 137 of 2011 which suit pits the said administrator against the applicants presently seeking revocation, I am of the view that:
a) The main issues to be determined in the revocation application are also raised by the pleadings in HCC No. 137 of 2011, pending before the Environment and Land Court,
b) It is more efficient and prudent that these issues be considered and determined simultaneously by one judge.
I order therefore that this cause and HCCC No. 137 of 2011 be placed before Angote J on 10th December, 2013 so that directions can be given as to the taking of further proceedings.
Delivered and signed at Malindi this 3rd day of December, 2013 in the presence of Mr. Otara holding brief for Wesley John for the Petitioner.
