The court held that it has jurisdiction to determine objections or protests in succession matters under the Law of Succession Act and Probate & Administration Rules. However, the protestor, being a brother to a deceased wife of the intestate, is neither a beneficiary nor a dependant of the deceased's estate. The right of a spouse to a share in the estate is extinguished upon her death prior to distribution, and any life interest or entitlement does not survive her. Section 39 of the Law of Succession Act does not apply where there are surviving children of the deceased, as section 40 governs such distribution.
