Succession Cause / Ruling on Confirmation of Grant
Legal Issues
- 1 Whether the grant of representation (probate) should be confirmed given that the last minor beneficiary has attained majority age.
- 2 Whether the estate should now be distributed and administered in accordance with the Will.
Ratio Decidendi
The court confirmed the grant of representation (probate) to Amos Okeyo Odago because the last minor beneficiary, Verlerie Onyuro, had attained the age of majority (18 years) as per the Will. There were no outstanding objections or impediments to the confirmation. The court directed that the estate be fully distributed and administered within six months, and set a mention date to ensure compliance and closure of the file. The decision was grounded in the Law of Succession Act, which allows for confirmation of grant when all beneficiaries are of age and the estate is ready for distribution.
Court Disposition
grant of representation confirmed; estate to be distributed and administered within 6 months; mention for closure set
Orders
- The grant of representation (probate) issued to Amos Okeyo Odago is confirmed.
- A certificate of confirmation to issue forthwith.
