Procedural Posture

Succession Cause / Ruling on Summons for Rectification of Grant

  1. 1 Whether the court can rectify a certificate of confirmation of grant to include additional assets not previously listed.
  2. 2 Whether the inclusion of new assets constitutes a rectification under section 74 of the Law of Succession Act and Rule 43(1) of the Probate and Administration Rules.
  3. 3 Whether the court has inherent jurisdiction to make orders necessary for the ends of justice in succession matters.

Ratio Decidendi

The court held that while section 74 of the Law of Succession Act and Rule 43(1) of the Probate and Administration Rules limit rectification to errors in names and descriptions, the inclusion of new assets is a substantive change that ordinarily requires a review of the confirmation orders. However, invoking its inherent jurisdiction under Rule 73, the court found it could grant the orders sought to meet the ends of justice. Accordingly, the summons for rectification was allowed, and the Certificate of Confirmation of Grant was ordered to be rectified as prayed, with costs in the cause.
