Ratio Decidendi

The court held that, while the applicants are close relatives of the subject and have the support of the family and area chief, they failed to provide a medical report from a psychiatrist as required by the Mental Health Act. Treatment notes alone do not meet the evidentiary threshold for establishing mental disorder and incapacity to manage one's affairs. The law mandates expert evidence to satisfy the court that the subject is suffering from a mental disorder to the extent contemplated by the Act. In the absence of such evidence, the application is incompetent and cannot succeed.
