Procedural Posture

Succession Cause / Ruling on Notice of Motion for Consolidation and Transfer of Suits

  1. 1 Whether the court should order the transfer and consolidation of Kakamega ELC case no 26 of 2017 and Kakamega Med/HC/214 of 2019 with the present succession cause.
  2. 2 Whether the High Court has jurisdiction to transfer and consolidate matters reserved for the Environment and Land Court.
  3. 3 Whether mediation order no 214 of 2019 can be treated as a separate suit for consolidation purposes.

Ratio Decidendi

The court found that it lacked jurisdiction to transfer and consolidate Kakamega ELC case no 26 of 2017 with the present succession cause because the Environment and Land Court and the High Court are distinct courts with separate jurisdictions as established by the Constitution. The proceedings in ELC no 26 of 2017 were not availed, making it impossible to ascertain similarity of parties and subject matter. Additionally, mediation order no 214 of 2019 was adopted as an order in ELC no 26 of 2017 and could not be treated as a separate suit. Furthermore, ELC no 26 of 2017 had been withdrawn, leaving nothing to transfer or consolidate. The application was therefore misconceived and dismissed.
