The court found that the appeal was filed outside the statutory thirty-day period provided under section 79G of the Civil Procedure Act. The appellants did not seek leave of the court to file the appeal out of time, nor did they provide good and sufficient cause for the delay. The court held that it could not exercise discretion to admit an appeal that was already filed out of time without prior leave, as doing so would amount to remedying an illegality. The preliminary objections raised by the respondents were therefore merited.
