IN THE MATTER OF AN APPLICATION BY BEATRICE ATIENO OLOM and RITA AWUOR MISWA
Ruling
1. All the beneficiaries of the estate of the late Isaac Nehru Otieno Miswa as per the amended summons of confirmation of grant dated 22nd October 2024 and supported by the administrator’s affidavit sworn on the same day have agreed on the mode of distribution of the estate.
2. Accordingly, I hereby confirm the grant issued on 25th April 2024 and order that the distribution of the estate shall be as proposed in paragraph 5 of the affidavit in support of the amended summons for confirmation of grant dated 22nd October 2024.
3. A certificate of confirmed grant to issue reflecting the agreed mode of distribution of the estate. This is subject to the Petitioners complying with Section 83 of the Law of Succession Act on filing of accounts into court upon full distribution, within 6 months of today.
4. This file is therefore temporarily closed pending filing of accounts.
